CHAP. 378.

trict, if in their opinion such division will conduce to
the interest and convenience of the inhabitants of said
district.

To contract.

SEC. 2. And be it enacted, That so soon as the said,
commissioners shall have laid out the said school dis-
trict and made their report to the levy court, which
they are hereby required to do within sixty days from
the passage of this act, to he by the said levy court
recorded, it shall be the duty of the trustees of the
school fund of Prince George's county, and they are
hereby directed to contract for and superintend the
erection and construction of a school house in said

district; provided, the cost thereof shall not exceed
three hundred and fifty dollars, and for that purpose
the said trustees are hereby authorised to condemn
any land in said district, on which to erect said school
house for the public use, and to value the same, which
said valuation, together with the cost of erecting said
house, shall be paid for in the manner provided by
the act of December session, eighteen hundred and
thirty-eight, chapter sixty-one.

To appoint
teachers.

SEC. 3. And be it enacted, That so soon as the said
school house is erected and completed, the said trus-
tees shall have power to employ a teacher therefor,
and pay him in the same manner as other teachers of
primary schools are paid, and the levy court of Prince
George's county are hereby directed annually there-
after to levy and assess upon the taxable property of
said county, subject to the order of said trustees, such
sum of money as may be necessary to pay the annual
salary of said teacher, to be collected and paid as other
teachers are paid.

When built, to
be deemed
free school.

SEC. 4. And be it enacted, That the school house
heretofore mentioned and directed to be built, be
deemed and considered as a free school, and it is here-
by placed on the same footing, entitled to the same
privileges and subject to the same regulations that
other free schools in said county are subject and enti-
tled to.

Duty of sur-
veyor.

SEC. 5. And be it enacted, That the surveyor of the
county is hereby directed to give his services if re-
quired, to survey and lay out the said district and lot
of ground, which may be deemed necessary for the
erection of said school house hereinbefore directed to
be built, and the levy court is hereby directed to allow
said surveyor such compensation for his services, as
they may deem adequate.
