1849.

nership, formed under the provisions of the act re-
lating to limited partnerships in this State, passed at
December session, eighteen hundred and thirty-six,
chapter ninety-seven, may he conducted under the

name of any or more of the general partners, and with
or without the addition of the word Co., or Company,
as the parties may determine, and in any action or
suit to be brought on any contract or engagement of
said partnerships, or to enforce any liability of the
same, the general partner, whose name is used in said
firm or name of business, shall be the only necessary
parly defendant, and any judgment or decree recorded
against said defendant, shall have the same legal effect
and operation, and execution thereon shall be enforced
and have like effect as if the said judgment or decree
had been recovered against all the general partners,
under the provisions of the said original act.

CHAP. 348.

SEC. 2. And be it enacted, That all parts of said

original act, inconsistent with, or repugnant to the
provisions of this act, be and the same are hereby re-
pealed.

CHAPTER 349.

Inconsistent
acts repealed.

An act to alter and amend the Constitution and Form
of Government, so as to provide for the election of
Clerks and Registers of Wills immediately by the
people.

5, 1850.

SECTION 1. Be it enacted by the General Assem-
bly of Maryland, That on the first Wednesday of Oc-
tober, in the year eighteen hundred and fifty-two, and

in every seven years afterwards, and in every year in
which a vacancy, as mentioned in the third section
of this act shall occur, the persons legally qualified to
vote for delegates to the General Assembly of Mary-
land, in each of the counties, Baltimore city, and
Howard District, shall elect, by ballot, a clerk of the
county, city or district court, as the case may be, and
a Register of Wills for their respective counties and
Howard District, and that the election for the afore-
said Clerks and Registers shall be held, conducted and
certified in all respects, like elections for Sheriff, ex-
cept that a voter shall not vote for more than one per-
son for Clerk, nor for more than one person for Re-
