CHAP. 309.

of this act, shall proceed to act under its provisions, un-

less he take and subscribe, in the presence of some jus-
tice of the peace, the following oath: I do solemnly
swear, or affirm, as the case may be, that in all things,
to the best of my ability, I will perform the trust reposed
in me by this act, which said oath shall be filed and re-
corded in the office of the county clerk, and shall give
bond, in the penalty of five hundred dollars, for the
faithful and honest administration of the school funds,
and all other funds applicable to the purposes of educa-
tion, in and for Carroll county, and coming into their

hands; And it is further enacted, that each of said
school commissioners shall receive, for every day he shall
be actually employed under the provisions of this act,
the sum of one dollar and fifty cents, to be paid out of
the school fund of said county.

prohibited.

SEC. 10. And be it enacted, That no part of said
school fund now in hand, nor any other funds applica-
ble to the purpose of education in primary schools in
Carroll county, shall be applied to the building of school
houses, and that taxation for the purpose of education is
hereby prohibited in said county.

SEC. 11. And be it enacted, That this act shall be
published once a week, for four weeks next preceding
the next gubernatorial election, in at least two newspa-
pers in Carroll county, and unless it be confirmed by a
majority of the legal voters of said county, at said elec-
tion, cast for or against said act, it shall be null and
void, and the legal voters of said county are hereby re-
quested to answer yes or no, when they come to the
polls, to the question, are you for or against an act to
establish primary schools in Carroll county, and it is
hereby made the duty of the judges of elections to put
said question, and to count the votes for and against
said act, and to make return thereof to the county clerk,
whose duty it shall be, if a majority of votes are cast in
favor of said act, within one week thereafter, to give
public notice through said newspapers, that an election
will be held on the first Wednesday of June, eighteen
hundred and fifty-one, at the usual places of holding
elections in said county, for the election of said commis-
sioners of primary schools.

Quorum.

SEC. 2. And be it enacted, That not less than a ma-
jority of the school commissioners, to be elected under
the provisions of this act, shall constitute a quorum for
the transaction of business, and that the said board of
school commissioners shall have power to make bye-
