CHAPTER 289.

An act to authorise the Judges of the Levy Court of
Frederick county, to levy a sum of money to build a
Bridge over the Monocacy, at or in the vicinity of
either the Old Furnace or Greenfield Mills Fords,
and to appoint Commissioners to fix upon a site for
said Bridge.

SECTION 1. Be it enacted by the General Assem-
bly of Maryland, That the judges of the levy court of
Frederick county, be and they are hereby authorised,
in their discretion, to levy on the assessable properly in
said county, the sum of ten thousand dollars, to build a
bridge over the river Monocacy, at or in the vicinity of
either of the fords known as the Greenfield mill and old

furnace fords; provided, the said judges of the levy
court shall not levy more than two thousand five hun-
dred dollars in any one year for said purpose.

Commissioners
appointed to fix

SEC. 2. And be it enacted, That the said judges of
the levy court shall appoint three commissioners, who
shall be residents of said county, whose duly it shall be
to examine the several sites proposed, and they, or a
majority of them, shall decide and determine upon the
site, which in their judgment, will most promote the
public convenience, and they shall report to said court,
in writing, the result of such decision, and for the ser-
vice thus rendered, the levy court shall allow to said
commissioners reasonable compensation.

May condemn
land.

SEC. 3. And be it enacted, That the judges of the
levy court of said county, are hereby authorised to make
condemnation of lands for the same, also for the neces-
sary road or roads to pass to and from the said bridge,
and shall award to the owners of land, on which said
bridge shall be built or roads may be located, such dam-
ages as in their judgment said owners of lands shall
sustain, taking into consideration the advantages and

disadvantages thereof; provided, that the persons to
whom such awards may be made, shall not be deprived
of their right to appeal to the county court.

Notice to be
given.

SEC. 4. And bo it enacted That it shall be the duty
of said levy court, to give at least two months notice in
the several newspapers printed in Frederick city, for
proposals for building said bridge, and the said levy
court are authorised to contract with any person or per-
sons to build the same, and to take bond or bonds, with
such security as they may approve, for the faithful per-
formance of the contract so entered into.
