CHAP. 275.

Authority to
sell.

SECTION 1. Be it enacted by the General Assem-

bly of Maryland, That from and after the passage of
this act, it shall and may be lawful for James Whaley,
of Worcester county, and he is hereby authorised and
empowered, to sell at public sale, to the highest bid-
der, the said house and lot, upon such terms as he
shall deem advisable, after having given at least three
weeks public notice, by advertisements at such of the
most public places in the neighborhood of said pro-
perty as he shall deem advisable, of the time, place,
and terms of said sale; and he is hereby authorised
and empowered, when the whole of the purchase
money shall have been paid, and not before, to convey
to the purchaser or purchasers all the right, title, in-
terest and estate of the said widow, James W. Rider,
and Elizabeth B. Rider, in and to the said house and
lot, in fee simple, by a deed executed, acknowledged,

and recorded according to law; provided, nevertheless,
that the purchase money, if any, remaining unpaid,
shall, until paid, be and remain a specific lien on said
property.

To give bond.

SEC. 2. And be it enacted, That the said James
Whaley, before he shall proceed in the premises, shall
give his bond to the State of Maryland, with two se-
curities, in the sum of two thousand dollars, with the
clerk of Somerset county court, to be approved by
him, conditioned for the faithful performance of the
duties imposed upon him by this act, and for the pay-
ment of the money which may come into his hands
by reason of the sale of the real estate aforesaid, to
the persons legally entitled to the same.

An act to incorporate Horeb Division, number forty-six,

Sons of Temperance.

Incorporated,
&c.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That Isaac Newkirk, W. H. Heckrotte,
William H. Roads, E. Startsman, and others, the of-
ficers and members of Horeb Division, number forty-
six, of the Order of Sons of Temperance, of Mary land,
and their successors, be and they are hereby incor-
porated and made a body politic and corporate, by the
name and number of Horeb Division, number forty-
