CHAP. 363.

A supplement to an act entitled, an act to lay out and
establish a Road in Allegany County, passed at De-
cember Session, eighteen hundred and forty-seven,
chapter three hundred and thirty-two.

Passed Feb. 28,
1850.

SECTION I. Be it enacted by the General Assembly
of Maryland, That William C. Cunningham and Wil-

liam Frost, be and they are hereby appointed commis-
sioners to act in conjunction with the commissioners
named in the first section of the original act, to which
this is a supplement, and that the two commissioners
herein named, with three commissioners named in the
said original act, or any three of the five named in said
original act and in this supplement, shall have all the
power and authority given by said original act to the
three commissioners then named.

SEC. 2. And be it enacted, That if in the opinion
of the company of Savage river road, it shall be advisa-

ble and expedient to construct the said road, or any por-
tion of it, out of timber or plank, it shall and may be
lawful for the said company of Savage river road to have
said road, or any portion of the same, constructed of
timber or plank.

SEC. 3. And be it enacted, That the said company
of Savage river road, be and they are hereby authorised
if they deem the same necessary, to construct on a por-
tion of the bed of said road a, tram rail road; provided,
there shall not be less than sixteen feet of road left for
the ordinary travel to pass over; and provided further,
that said tram rail road shall be open for the use of all
persons desiring to place cars and horses on the same to
transport their own goods, wares, merchandise or art-

cles of value for trade, and shall pay the said company
of Savage river road, one cent per ton per mile, for toll,
for the use of the same; and provided further, that said
company of Savage river road, shall not charge a sum
exceeding three cents per ton per mile for horse power,
cars and tolls, when said company shall transport for
other persons.
