CHAP. 230.

porated under the act of the General Assembly of Ma-
land, passed at December session, eighteen hundred and
two, chapter one hundred and eleven, are desirous to
obtain authority to purchase and hold a parcel of land
in Baltimore county, and binding on the eastern mar-
gin of Gwynn's Falls, about midway between the Bal-
timore and Frederick turnpike road and the Calverton
mills, to be used as a public cemetery for the burial of
the dead — Therefore,

May hold land
not exceeding
fifty acres.

SECTION 1. Be it enacted by the General Assembly
of Maryland, That the trustees of the Fayette Street
Methodist Episcopal church, in the city of Baltimore,
and their successors, be and they are hereby authorised
to purchase and hold over and above the quantity of
land which they are authorised to hold under the act
aforesaid, not exceeding fifty acres of land, in Baltimore
county, situated as aforesaid, to be used as a public ce-
metery forever, for the burial of the dead, and for no
other purpose, which cemetery shall be known as the
Western Cemetery; provided, that the land so to be
purchased and held by the said corporation shall not
interfere with any public road or canal now located or
in use.

SEC. 2. And be it enacted, That no road, canal
or public highway shall be opened through the said ce-
metery, nor shall the said cemetery, so long as it is
used as such, to be liable to any public tux or imposi-
tion whatever.

Corporate
powers.

SEC. 3. And be it enacted, That the said corpo-
ration, in the management of the said cemetery, be and
they are hereby authorised to lay out and sell, or dis-
pose of burial lots, to appoint all necessary officers and
agents, and fix their several duties and compensations,
and to make such rules and regulations as they may
deem proper to conduct the affairs of said cemetery.

Penalty for
injuring, etc.

SEC. 4. And be it enacted, That any person who
shall wilfully destroy, mutilate, deface, injure or re-
move any tomb, monument, grave-stone, or other struc-
ture, placed in the cemetery aforesaid, or any fence,
railing, or other work, for the protection or ornament
of any tomb, monument, grave-stone, or other structure
aforesaid, or shall wilfully destroy, cut, break or remove
any tree, shrub or plant within the limits of said ceme-
tery, or shall shoot or discharge any gun, or other fire-
arms, within the said limits, shall be deemed guilty of
a misdemeanor, and shall upon conviction thereof, be-
fore any justice of the peace of Baltimore county or
city, be punished by a fine, at the discretion of the jus-
