CHAP. 222.

of every legal voter, as he deposits his ballot for or
against the convention, whether he is for or against
the establishment of common schools in said county,
as provided for by this act, and the said judges shall
record the number of votes so taken for and against
common schools, as provided for under this act, and
shall make immediate return thereof, under their hands
and seals, to the cleric of the said county, who shall
receive said returns and shall ascertain the number of
votes thus cast for and against said schools, in the
whole county, and when ascertained, shall cause the
same to be published in both the papers printed in
said county, and if a majority of the votes thus taken
in the said county shall be in favor of the schools to
be established by this act, then and in that case, this
act shall go into immediate operation, otherwise this

act shall be of no effect whatever; provided, that
the judges of the said election shall not record the
vote of any person for or against this said act, who
does not give a distinct affirmative or negative answer
to the said enquiry.

Act to be
published.

SEC. 37. And be it enacted, That it shall be the
duty of the clerk of the commissioners of the said
county to procure a copy of this act, and to cause the
same to be published in both the newspapers printed
in said county, once a week for at least one month
previous to the said second Wednesday in May next,
and that all expenses attending said publication shall
be paid as other county charges.

Inconsistent
acts repealed.

SEC. 38. And be it enacted, That all existing acts
of Assembly, inconsistent with the provisions of this
act, shall be and the same are hereby repealed, to take
effect from and after the time that this act shall go

into operation.
