any of the schools to be created by this, act, he or she
shall have power to enforce obedience, and when cir-
cumstances require it, may suspend a scholar tempo-
rarity, subject to an appeal to the trustees; the trustees
may expel a scholar for the term of their own elec-
tion, but parties aggrieved may appeal to the board of
education, who shall hear complaint and defence, and
confirm the action of the district trustees, or reverse
the same, and restore the scholar to the school; and
if any teacher be dismissed from the school by the
trustees of any district, and such teacher shall feel
himself of herself aggrieved thereby, he or she may
apply to the board of education for a hearing of his
or her case, and the said board shall hear the state-
ments and proofs of each party, and if, in their judg-
ment, the said teacher has been dismissed without
just cause, or for any cause not affecting his or her
moral character, or qualifications as a teacher, it shall
be the duty of the said board to give the said teacher
a certificate thereof; but the power of the board of
education shall not extend to the restoration of the
teacher to the school, against the wishes of the trus-
tees thereof.

Penalty for
neglect of duty.
|
SEC. 17. And be it enacted, That at any of the
stated or annual meetings of (he voters of any of the
said school districts, after the election for officers is
closed, and the result thereof certified by the chair-
man and secretary, it shall be lawful for said voters
present to adjourn said meeting to some day not ex-
ceeding twenty days thereafter, to be publicly named
at said stated meeting, and the proceedings at the ad-
journed meeting, shall be of the same nature and force
as if had at the original meeting; and if at any stated
or adjourned meeting of the school voters in any of
the said districts, the said voters shall determine to
raise a sum of money, which will require taxation,
and the trustees of the said district, or any other officer
of the district, shall neglect or refuse to perform any
duty required of them, or him, by this act, each trus-
tee or other officer so refusing, shall forfeit and pay
to the superintendent, for school purposes, the sum of
ten dollars for each offence, to be recovered by the
superintendent, before a single justice of the peace,
upon due proof thereof.

SEC. 18. And, for the purpose of raising a fund to
assist in the support of the schools to be established
under this act, be it further enacted, That a tax shall
be levied upon all salaries and emoluments of any
office created by, or held under, the constitution or
