1849.

intendent of common schools for Cecil county, I will
to the best of my skill and knowledge, execute and
perform all the duties required of me by the act of the
General Assembly of Maryland, passed at December
Session, eighteen hundred and forty-nine, entitled,
an act to establish a system of common schools in
Cecil county, and to provide for the support of the
same, without favor, affection, or partiality, and that
I, will faithfully account for, and pay over to the order
of the board of education of said county, or the local
hoards of trustees of school districts in said county
as provided for in said act, any and all monies that
shall come into my hands, by virtue of my said office,
and under the provisions of the said act, without de-
falcation or delay, he shall receive for his services,

the annual salary of eight hundred dollars, to be paid
out of the taxes levied and collected under the pro-
visions of this act, for school purposes; and for re-
fusing or neglecting to perform any of the duties
prescribed in this act, after having accepted and quali-
fied, he shall be subject to a fine of not less than ten,
nor more than one hundred dollars for each and every
offence, to be recovered by indictment in the county
court, and appropriated to the school fund of the said

county.

Salary $800.

SEC. 7. And be it enacted, That all existing acts of
Assembly, in relation to the poor school fund of Cecil
county, authorising and providing for its receipt and
disbursement by the orphans court of the said county;
for its investment in State stocks, bonds, and mort-
gages or otherwise, and for its apportionment among
the several election districts of said county, be and
the same are hereby repealed, and that the justices of

the said orphans court be and they are hereby autho-
rised, required, and directed, immediately upon the
passage of this act, to proceed to collect all outstand-
ing debts due to the said court, on account of the said
fund, by bond and mortgage, or otherwise, and to
hand over to the person who shall be first elected,
under the provisions of this act, superintendent of
common schools of said county, so soon as he shall
have taken the oath, and entered into the bond re-
quired by the fifth section of this act, all monies in
their hands, or in the hands of any officer of the said
court, belonging to the said poor school fund of the
said county, excepting so much of the current fund
in the hands of their treasurer, as may be necessary
to meet the regular demand for the tuition of poor
