State aforesaid, of the other part, be and the same is
hereby rendered and made valid, to all intents and purpo-
ses, as if the said deed had been duly and legally acknow-

this act shall operate or be construed to affect, or in any
manner interfere with any right or tide at law or in
equity of, in or to the property, or any part thereof,
mentioned in said deed, of any person or persons, ac-
quired subsequent to the date of the execution of said
deed, and previous to the recording of the same.

Proviso.

CHAPTER 217.

A further supplement to the acts of assembly, passed at
December Session, eighteen hundred and thirty-
three, chapter two hundred and fifty-four, and eigh-
teen hundred and thirty-seven, chapter three hundred
and ten, passed for the protection of Oysters in the
waters of this State.

Passed Feb. 23,
1850.

SECTION 1. Be it enacted by the General Assembly
of Maryland, That for any offence committed against

the provisions of the first section of the act of Assembly,
passed at December session, eighteen hundred and thir-
ty-three, chapter two hundred and fifty-four, the offend-
er or offenders shall be subject to presentment and in-
dictment by the grand jury of the county, where the of-
fence may have been committed, and on conviction
thereof in the county court of the said county, the cap-
tain of the boat or vessel shall be fined not less than fif-
ty, nor more than two hundred dollars, and each hand
on board shall be fined not less than twenty-five, nor
more than one hundred dollars, in the discretion of the
court, for every offence, which said fine shall be paid
over to the commissioners of the county, for the benefit

of the school fund of the county; provided however,
that in case any person or persons indicted or presented
by virtue of this act, shall prove at the trial of the pre-
sentment or indictment, that he or they have been pun-
ished as provided by the said act of assembly of eigh-
teen hundred and thirty-three, chapter two hundred and
fifty-four, he or they shall be discharged from further
prosecution under the said presentment or indictment.

Proviso.

SEC. 2. And be it enacted, That whenever in the
discharge of his duty under the said acts of the General
