CHAP. 268.

CHAPTER 208.

Passed Feb. 28,
1850.

An act to change the public road leading from Mur-
ley's Branch to Oldtown, in Allegany county.

Location to be

changed.

SECTION 1. Be it enacted by the General Assembly
of Maryland, That Eli Wilson, Henry A. Jamison and
Martin L. Cresap, of Allegany county, be and they are
hereby appointed commissioners to change and improve
the location of the public road leading from Murley's
Branch to Old Town, in Allegany county, so that the
northern end of the new location shall commence at the
top of Twigg's hill, and the southern end thereof shall
terminate at a point on the road leading from Oldtown
to Cumberland, not more than one mile and a half west
of Martin L. Cresap's mill.

Duty of com-
missioners.

SEC. 2. And be it enacted, That the said commis-
sioners, or a majority of them, shall appoint a suitable
person to survey the said newly located road, and to
make a plat of the same, which shall be returned by the
said commissioners, together with the report of their pro-
ceedings under this act, into the office of the clerk of
Allegany county court to be recorded.

Indemnity.

SEC. 3. And be it enacted, That in every case
where the old road now runs through the land of any
person or persons who shall give the right of way, free
of charge, for the new location through his, her or their,
lands, it shall be lawful for such person or persons to
enclose and vacate the part of the old road which now
passes through his, her or their land, and to appropriate
the same to his, her or their private use, so soon as the
new road shall be opened.

Compensation.

SEC. 4. And be it enacted, That each of said com-
missioners shall be allowed two dollars per day, and the
surveyor four dollars per day, while employed in said
service.

ed.

SEC. 5. And be it enacted, That the commissioners
of Allegany county shall levy a sufficient sum of mo-
ney, on the assessable property of said county, to defray
the expenses of locating and opening the said road.
