violating the provisions of this act, are hereby declared

to be competent witnesses.

CHAP. 165.

SEC. 3. And be it enacted, That no citizen or non
citizens, included in the preceding section, shall know-
ingly hold as property in this State any slave for

life, or for a term of years, who shall have been con-
victed of any crime in any other State, District or Ter-
ritory in the United States, for which exportation from
such State, District or Territory shall have been the
punishment, and any person or persons offending shall
forfeit for every such offence any slave for life, or for a
term of years, brought into this State contrary to this
act; and the said slave for life, or for a term of years,
shall be seized and taken, and confined in jail by the
Sheriff of the county, city or district where the offence
is committed, which Sheriff shall receive Ten Dollars
for every slave for life, or for a term of years, so brought
into this State and forfeited as aforesaid, and seized and
taken by him, to be recovered in an action of debt in
his own name before any justice of the peace, as small
debts are recovered, from the person or persons so
offending; moreover the said Sheriff shall receive five
dollars for such slave for life, or for a term of years, ac-
tually confined by him in jail, and the usual prison fees
now allowed by law, and any person or persons so of-
fending under this act shall be punished by indictment
in the court of the county, city or district where the of-
fence shall be committed, and upon conviction thereof
the said court shall by its order direct said Sheriff after
ten days public notice given by public advertisement to
be set up at the court-house door of the county, city or
district in which said Sheriff resides, to sell any such
slave for life, or for a term of years, to some person or
persons with a condition that any such slave for life, or
for a term of years, shall be removed beyond the limits
of this State to settle and reside; and the said Sheriff shall
report any sale or sales made by him to the county court
of the county, city or district in which he resides, and af-
ter deducting five dollars and prison fees, for each and
every slave for life, or for a term of years, sold as afore-
said, which shall be settled by an account current to be
settled in said court,said Sheriff shall pay over the balance-
on said sales to the Treasurer of the State of Maryland.

SEC. 4. And be it enacted, That any person bringing
into this State any negro, mulatto slave or slaves for life

or for a term of years, from any State, District or Terri-
tory of the United States, for the purpose of sale be-
yond the limits of the State of Maryland, and who shall
sell the said slave or slaves to be transported beyond the
limits of the State of Maryland, shall, upon conviction
