CHAP. 161.

Annual report.

SEC. 13. And be it enacted, That it shall be the
duty of the board to report annually, on the first Mon-
day in January, in each and every year, to the county
commissioners, a statement of its transactions, with an
account of the receipts and expenditures of the past
year, and an estimate of the expense for the ensuing
year.

Report to be
published.

SEC. 14. And be it enacted, That it shall he the
duty of the county commissioners, to have published
annually, copies of the annual report of the board of
school commissioners, in each newspaper printed in said
county.

Duty of the
teachers.

SEC. 15. And be it enacted, That it shall he the
duty of the teachers of every academy in said county,
receiving a donation from me State, to educate, in ad-
dition to the pupils now required by law to be taught
gratuitously, an equal number of scholars to be desig-
nated by the executive board as aforesaid, so as to fit
them to become teachers of the public schools; to give to
such persons who shall be so educated and qualified,
certificates of their being so qualified, and the said
board in the selection of teachers for the public schools,
shall give preference to those persons having such cer-
tificates; and if the said teachers of academies or any of
them shall refuse to receive and educate the pupils so
designated by .paid board, on the terms prescribed by
said board, such refusal shall forfeit all claim by the
teacher, so refusing, to receive any part of the donation
now allowed to such academy.

Duty of treas-
urer.

SEC. 16. And be it enacted, That when this act
shall go into operation as hereinafter prescribed, it shall
be the duty of the said treasurer to receive, safely keep
and disburse, according to the provisions of this act, the
school fund now belonging to said county, and the taxes
levied for the use of the public schools, in pursuance of
this act, and the official bond of said treasurer, given and
required to be given by him as register of wills, shall be
so modified in its form as to be made liable for any fail-
ure to perform the duty required by this act.

Collector — pe-
nalty for failure.

SEC. 17. And be it enacted, That on the failure of
any collector to collect and pay over the tax for the ben-
efit of the public schools, he shall be subject to the
same process as now provided, for failure to collect and
pay over other county taxes.

To be submit-
ted to people.

SEC. 18. And be it enacted, That it shall be the duty
of the county commissioners to have this act published
in the newspapers printed in said county, at least three
months before the election of Governor, which election
is to be held on the first Wednesday in October next,
