CHAP. 160.

Tolls regulated.

SEC. 11. And be it enacted, That the said company
having perfected the said road or such parts thereof, and
the same being examined, approved and licensed in man-
ner aforesaid, it shall and may be lawful for them to
erect a toll gate at the intersection of the said road with
the Frederick turnpike, or at such oilier point or points as
may be deemed expedient, by them, and appoint a toll
gatherer or toll gatherers, to collect and receive from all
and every persons using the said road, the tolls and rates
hereinafter mentioned, and to stop any person or per-
sons riding or driving any horses, cattle, sheep, stage,
wagon or carriage, from passing through said gate, un-
til they shall have paid the same, and the rale of tolls
for passing through said gate or using said road one or
more times during the twenty-four hours, shall be as
follows, namely: for every score of sheep or hoes, four
cents; for every score of cattle, eight cents; for every
horse and his rider or led horse, three cents; for every
chair, chaise or vehicle with one horse, six cents; for
every stage, wagon or vehicle with two, horses, twelve
cents; for every other carriage or vehicle, under whatev-
er name it may go, the like sum, according to the num-
ber of horses drawing the same; for every cart or wag-
on, whose wheels measure four inches or more in,
breadth, three cents for every horse drawing the
same.

Oxen and mule.

SEC. 12. And be it enacted, That every two oxen
used as aforesaid, shall be estimated as equal to one
horse, in the charging of said tolls, and every mule as
equal to one horse.

Penalty for
evading pay-
ment of tolls.

SEC. 13. And be it enacted, That if any person
or persons whatsoever, riding or driving anything what-
soever, or leading the, same, shall therewith pass through,
any private gate or bar, or along or over any private
passage way or other ground near to, or adjoining any
turnpike gale, which shall be erected in pursuance of
this act, with intent to defraud the company, and avoid
the payment of toll for passing through such gate, or if
any person or persons cause the same to be done, with a
view either to lessen, or defraud the company of the
toll, and all and every person so offending, either direct-
ly or indirectly, shall for every such offence, respective-
ly, forfeit and to pay to the said managers, president
and company of the road, a sum not exceeding ten dol-
lars, to be sued for and recovered with cost of suit, be-
fore any justice of the peace, in like manner as debts
of a similar amount may be sued for and recovered,
and if any toll gatherer shall demand, and knowingly
receive any greater toll, than he is authorised to demand
