CHAP. 311.

Commission-
ers appointed
to locate road
and assess the
damages

SECTION 1. Be it enacted by the General Assembly of
Maryland, That Joshua F. Cockey, Peter Fowble and
John Cockey, of Baltimore county, be and they are
hereby appointed commissioners to locate said private
road or right of way for the said Christopher M. Gill

and to award such damages as they may deem right and
proper to all persons aggrieved by said location, which
damages shall be first paid by the said Christopher
Gill before he shall have the benefit of this act.

Decision to be
final.

SEC. 2. And be it enacted, That the decision of the
commissioners shall be conclusive on all the parties in-
terested in said road, any thing in any act to the con-
trary notwithstanding.

Preamble.

An act to authorise the recording of a paper therein
mentioned, in Worcester County Court.

WHEREAS, a certain James Perdue, of Worcester
county, by his last will and testament devised certain
lands to his three sons, John K. Perdue, James W.
Perdue and Elijah C. W. Perdue, to be equally divided
between them, and such division having been made
under the direction of Worcester county court, the re-
cord of such proceedings has been lost by the burning
of the court house; and whereas, there is in the hands of
the present owners of such lands a copy of the return of
the jurors or commissioners who made such decision,
with the exception of the date, which has been acci-
dently torn off; and whereas, this is the only evidence
of the division as aforesaid — Therefore,

To he record-
ed, and when
recorded to be
valid.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That upon proof being made before Wor-
cester county court by the owners of certain lands
devised by a certain James Perdue, to his sons, John
K. Perdue, James W. Perdue and Elijah C. W. Pur-
due, that the copy of the record relating to the pro-
ceedings of the jurors or commissioners who made the
division of said lands under the direction of said
court is correct in all other respects but the dale there-
of, said court is hereby required to direct the clerk of
said court to record said copy of the return of said com-
missioners among the records of said county, and upon
proof being made as aforesaid, said paper shall be con-
sidered as valid in law as the original would be.
