1847.

holders to serve for one year and until others shall be
elected, and until the first election of directors shall
be held the said Christian E. Detmold and Archibald
Carey shall have full power and authority to exercise all
corporate powers of said company, and in case of any
vacancy occuring in the presidency or directors of said
company, the remaining directors shall have the power
to fill such vacancy by appointing some other stock-
holders until the next general election thereafter.

CHAP. 230.

SEC. 6. And be it enacted, That a general meeting
of the shareholders shall be held so soon as the com-
pany is organised, and annually thereafter on the first
Monday in May in each year, at the office of said com-
pany in Allegany county.

SEC. 7. And be it enacted, That nothing in this act
be so construed as to authorise the said corporation to
issue any note, token, device, scrip or other evidence of
debt to be used as currency.

SEC. 8. And be it enacted, That this act shall com-
mence and be in force from and after the passage thereof,
and that it shall at all times from the organization of
the company be liable to be annulled or repealed at the
pleasure of the legislature.

CHAPTER 230.

In force.

Reservation.

An act entitled, a further supplement to the act entitled, an
act imposing a tax on commissions allowed to Ex-
ecutors and Administrators to aid in paying the debts
of the State, passed at December session eighteen hun-
dred and forty-four, chapter one hundred and eighty-
four.

March 9, 1848.

WHEREAS, doubts have arisen under the act of eigh-
teen hundred and forty-fire, chapter three hundred and
ninety-one, being a supplement to the act of eighteen
hundred and forty-four, chapter one hundred and eighty-
four, whether an executor or administrator is bound to
pay any tax where he claims no commissions, therefore,
to remove all such doubts,

Preamble.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That it shall be the duty of the Orphans
court of the county in which letters testamentary or of
administration are granted, to fix and determine in every
case the amount of the commissions to which the execu-
