CHAPTER 220.

CHAP. 220.

An act incorporating a Company to open and improve a
Road from Frederick, in Frederick County, to Leiters-
burg, in Washington County.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That subscriptions books shall be opened for
R capital of twenty thousand dollars in shares of twenty
dollars each, and that William F. Johnson, Lewis Med-
tart, Joshua Daub, Abraham Kemp and M. E. Burgis
be and they are hereby appointed commissioner's to
receive subscriptions at Frederick; that Adam Shank
Lewis Tritle, E. Bishop, William B. McAtee, John J.
Brick be and they are hereby appointed commissioner
to receive subscriptions at Smithsburg, in Washington
county, and that Christian Strite, John Byer, Andrew
Shank, George H. Lambert and Joseph Letter be and
they are hereby appointed commissioner's to receive
subscriptions at Leitersburg, in Washington county
and that books for receiving said subscriptions at the
several places herein named shall be opened on the first

Monday of May next, of which three weeks previous
notice shall be given in two or more newspapers of
Hagerstown, and in two or more newspapers of Frede-
rick, at which respective times and places two at
least of said commissioners respectively shall attend and

keep open said books for subscriptions for at least three
clays, and shall, at the termination of that period, make
out true lists of the names of all subscribers, with the
shares subscribed by each, to be returned by said com-
missioners respectively to the clerks of Frederick and
Washington county, who are hereby severally autho-
rised and directed to record the same among the lamb
records of their respective counties, and an attested
copy of such records, under the official seat of either of
said officers, shall in all cases be sufficient evidence of
such subscriptions.

SEC. 2. And be it enacted, That the stockholders
in said company be and they are hereby incorporated
and established a body politic by the names of the
President and Directors of the Frederick and Smiths-
burg road company, and by the same names shall have
successors during the continuance of this incorpora-
tion, and the said stockholders and their successors by
the name aforesaid shall sue and be sued, answer and
be answered, petition or complain in any court of law
or equity in this State or elsewhere, and may do or exe-
