1847.

shall ascertain the number of votes given as aforesaid
Cor candidates for the levy court aforesaid, and by a cer-
tificate to be filed in the office of the clerk of the county
court of the county aforesaid, and which shall be by
said clerk recorded, certify in form similar to the certi-
ficate of the election of delegates, that the three per-
sons by name, who they shall ascertain received the
greatest number of votes in said county, are duly elect-
ed members of the levy court of Calvert county, to serve
for the period of two years from the date of their said
election; and in the event of a tie between two or more
persons, the same shall be decided by ballot at the first
regular meeting of said levy court.

CHAP. 28-

SEC. 4. And be it enacted, That if any member of the
said levy court shall die, resign, refuse or neglect to
qualify within twenty days, as members of the levy court
aforesaid under this act, or shall remove from the said
county at any time within the period for which he shall
have been elected, the residue of the said members of
the levy court shall appoint a person, as is hereinbefore
provided in case of an original election, to fill his place
until the next election for members of the levy court
aforesaid.

SEC. 5. And be it enacted, That the members of the
levy court so elected or appointed shall, before they en-
ter upon the discharge of their duties, qualify in such
manner and form as the law prescribes.
SEC. 6. And be it enacted, That the members of the

levy court aforesaid, shall receive two dollars per diem.

Compensation.

SEC. 7. And be it enacted, That so much of any acts
of Assembly as may be contrary to, or inconsistent with
this act, be and the same are hereby repealed.

CHAPTER 28.

Inconsistent
acts repealed.

An act to incorporate the American Telegraph Company.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That H. McKim, Z. Barnum, Moor N.
Falls, William McKim, D. Paine, Josiah Lee, Henry J.
Rodgers, George C. Penniman, and their associates, are
hereby created a corporation and body politic, for the
purpose of erecting and maintaining a line of Electric
Telegraph, on the routes leading from the city of Bal-
timore, in the State of Maryland, to York, Columbia
