from which the authority under which they acted issued,
or to some other justice of the peace in and for said
county, the same shall be recovered upon production of
competent testimony by the party complaining before any
district court in said county.

CHAP. 85.

SEC. 3. And be it enacted, That it shall be the espe-
cial duty of all constables to execute the provisions of this
act, for which he shall be entitled to one-half of the said
penalty, the other half to be paid by said constables to
the clerk of the county court, subject to the order of the
commissioners for the use of the county.

SEC. 4. And be it enacted, That if the said commis-
sioners shall report the enclosures in good and proper
order, the expense of said inspection shall be paid by the

party complaining.

SEC. 5. And be it enacted, That all acts or parts of
acts inconsistent with the provisions of this act, be and
the same are hereby repealed.

CHAPTER 85.

Repealed.

An act entitled, a further supplement to an act, passed at

December session, eighteen hundred and forty-four,
chapter one hundred and forty, allowing George Beck-
enbaugh, late collector of the county taxes for Frederick
County, further time to complete his collections.

Passed Feb.
19, 1847.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That the time allowed George Beckenbaugh,
late collector of the county taxes for Frederick county,
to complete his collections, by the act of December ses-
sion, eighteen hundred and forty-four, chapter one hun-
dred and forty, to which this is a supplement be, and the
same is hereby extended to the first day of April, eigh-
teen hundred and forty-eight.

SEC. 2. Be it further enacted, That before the said
George Beckenbaugh shall proceed to collect said taxes, he
shall take an oath before some justice of the peace of said
county, that said tax or taxes are due and unpaid, and
that he has not, nor any person, for him, received all or
any part thereof, or any security for all or any part

their assent thereto in writing in the office of the clerk of
