CHAP. 359.

said county, which shall be good and sufficient evidence
of the location and boundaries of said school districts
therein mentioned.

Upon applica-
tion primary
schools, &c.

SEC. 3. And be it enacted, that upon application, in
writing, of ten taxable inhabitants within the limits of
any of the aforesaid school districts, to the orphans
court of said county, it shall be their duty, and they are
hereby required to appoint three suitable persons, resi-
dents of the district applying for the establishment of a
primary school therein, to hold an election, and notify
said persons so appointed, under their hands, in any man-
ner most convenient.

SEC. 4. And be it enacted, That the persons so ap-
pointed, by the prorisions of this act, shall appoint two
persons to act as clerks to the election then to be held,
who, together with the judges aforesaid, shall qualify in
the same manner as the judges and clerks of the State
elections are required to qualify.

Judges to give
notice.

SEC. 5. And be it enacted, That the said judges, or a
majority of them, immediately on notice of their appoinl-
ment, shall then give notice, in writing, to be put up at
least in three public places in said district, staling the
time and place of holding electron, which shall be at
least ten days before said election takes place, and the
time which the polls shall be opened, which shall be at
one o'clock in the afternoon, and remain open until six
o'clock in the afternoon, at which time all persons resi-
dents of said school district, legally entitled to vote at
the State elections, may vote by ballot for seven persons
for trustees, whose names shall be written or printed
thereon, and at the same time the ballot is given, the
judges aforesaid shall ask whether he is in favor or against
primary schools, and if a majority of the voters shall be
in favor when so expressed, then it shall be declared a
primary school for three years, and the judges aforesaid
shall return a list of the votes cast for and against, with
the poll books, under their hands and seals, to the regis-
ter of wills of said county, to be filed by him with the
other paper relating thereto, and the seven persons voted
for, receiving the greatest number of votes, shall be de-
clared elected.

Trustees to

years.

SEC. 6. And be it enacted, That the trustees elected
as aforesaid, shall serve for three years from the day of
election, or until others are elected in like manner to fill
their places; and in case of a vacancy in said board of
trustees, the remaining trustees shall have power to fill
said vacancy until a new election.
