thereafter, shall be made in like manner as in electors of
president and vice president, save that the form of the cer-
tificate shall be varied to suit the case; and save also, that
the returns, instead of being made to the Governor, shall be
made to the Chancellor ol the State, and addressed to
the Chancellor of Maryland, under cover by the several
judges of elections, in the different counties of this State,
Howard District and the city of Baltimore.

CHAP. 348.

SEC. 2. And be it enacted, That, of the persons voted
for as Governor at any such election, the person having,

in the judgment of the Chancellor, the highest number

of legal voles, and possessing the legal qualifications,
and resident in the district from which the Governor, at
such election, is to he taken, shall be declared, by pro-
clamation of the Chancellor, within ten days after such
election returns have been received, duly elected Gover-
nor of Maryland, and shall qualify as such in the man-
ner prescribed by the constitution and laws of this State,
on the h'rst Monday of January next ensuing his election,
or as soon thereafter as may bo.

SEC. 3. And be it enacted, That excepting the cases
hereinafter provided, the Chancellor shall decide all

questions in relation to the number and legality of the
votes given for each and every person voted for as Go-
vernor, and in relation to the returns, and in relation to
the qualification of persons voted foi as Governor.

Sec. 4. And be it enacted, That in case two or more
persons, legally qualified according to the provisions of
the constitution of this State, shall have an equal number
of legal votes, then and in that case the Chancellor shall
communicate the fact, within ten days after the reception
of the election returns of the Staie, in writing to the
then Governor, whose duty it shall be, an 1 who is here-
by authorised and directed to convene, by proclamation;
upon reasonable notice, the General Assembly, before
whom the Chancellor shall forthwith lay all the election
returns, and the Senate and House of Delegates, upon
joint ballot, shall determine which one of them shall be
Governor, and the one which, upon counting the ballots,
shall have the highest number df votes, shall be Gover-
nor, and shall qualify as such.

SEC. 5. And be it enacted, That in case any one voted
for at such an election as Governor, and possessing the
legal qualifications, according to the constitution of this
State, shall come forward within thirty days after such
election, and make oath, before the Chancellor of Mary-
land, that he has good and sufficient reason to believe
