CHAP. 34.

CHAPTER 33.

An act to provide for the removal of a private Burying
Ground, in the City of Baltimore, and for other pur-
poses.

Authorised to

sell.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That the proprietors of lots numbered thirty-
two and forty-three, situated at the north-easterly corner
of Ostend and Warner, formerly Ridgely streets, in
Ridgely's addition to Baltimore town, being a private bu-
rying ground be, and they are hereby authorised to sell the
same in fee simple, and that Nathaniel Williams be, and
he is hereby constituted a trustee to represent Charles
R. Home, one of the said proprietors, who resides in
foreign parts, that is to say, in Buenos Ayres, in the sell-
ing and conveying the said lots, and in the appropriation
of the proceeds as herein after provided.

thorised, &c.

SEC. 2. And be it enacted, That if the said trustee
shall be of opinion, that it will be for the interest, and
agreeable to the wishes of the said Home, that such sale
be made, and on the trustee's approval thereof, the pro-
ceeds of such sale shall be applied to the purchase of
lots in Green Mount Cemetery, the building of a vault,
removing of the remains of those who are buried in said
private ground, in ornamenting the new purchased lots,
and in discharging all expenses occasioned in promoting
and fulfilling the purposes of this act.

Title vested in
proprietors.

SEC. 3. And be it enacted, That the title to the lots
so to be purchased in Green Mount Cemetery, and all
improvements and ornaments made thereon, and the in-
terests therein, shall belong to, and be vested in the afore-
said proprietors in the same manner, as they now hold
the said two lots, constituting the said private burying
ground.

CHAPTER 34.

29, 1847.

An act entitled, an act relating to certain Deeds of Mort-
gage therein mentioned.

Effectual and
valid.

SECTION 1 . Be it enacted by the General Assembly of
Maryland, That the several deeds of mortgage made
and executed by the Maryland and New York Iron and
