1846.

competent teacher by the year, the said trustees shall
have power so to employ a teacher, and the school kept
by such teacher so employed in any district, shall be free
to all the children in such district; provided nevertheless,
that the trustees of any district so employing a teacher by
the year, shall not pay to any such teacher employed by
them, the portion of the common school fund allotted to
said district, until after all the money subscribed as afore-
said, shall have been actually collected and paid over to
such teacher.

CHAP. 259.

Proviso.

SEC. 4. And be it enacted, That if the trustees shall

fail to raise a sufficient sum to employ a teacher by the
year, then the amount allowed to such school districts
from the State, shall go to the tuition of the poor chil-
dren in said school district, as directed by the law to
which this is a supplement.

SEC. 5. And be it enacted, That parents, guardians
and other persons having charge of children, may send
such children to the school which may be most conve-
nient to them, whether in their school district or not, under
such regulations as the trustees of such school may

SEC. 6. And be it enacted, That all laws of this State
inconsistent with the provisions of this act be, and the
same are hereby repealed, so far as the same relates to
Somerset county.

CHAPTER 259.

Repealed.

An act for the relief of Thomas I. Bond, John Bond and
Uriah F. Ruby, of Baltimore County.

WHEREAS, it is represented to this General Assem-
bly, that Thomas I. Bond, John Bond and Uriah F.
Ruby, of Baltimore county, are bounden in a certain
sura of money to the State of Maryland, for the mainten-
ance of a certain illegitimate child; and whereas, said
child has never been, nor is it likely ever will be a bur-
then to the county, being now over seven years ot age,
and whereas, the said Thomas I. Bond being unable to
pay, has at the suit of the State of Maryland, been con-
fined in the jail of Baltimore for three months—There-
fore,
