CHAP. 252.

the expense of the school fund; and it shall be the fur-
ther duty of the school commissioners diligently to in-
quire for, and ascertain such orphan nnd poor children
as are destitute of the means of education, and from time
to time, as far as the funds, under their control will ena-
ble them, to designate to the schoolmasters such orphan
and poor children as they may deem proper objects for
education out of said fund.

Teachers to
present their
accounts.

SEC. 4. And be it enacted, That the schoolmaster or
schoolmistress who may teach such poor children, shall
present his or her account for teaching the same, regu-
larly proved by his or her oath to the commissioners who
diiected the teaching the same; and if the believes the
account to be right, he shall direct, by an order, the
orphans court to pay the same; provided, the aggregate
amount of such orders drawn by any commissioner shall
not exceed the sixth part of the money allowed to the
district of which he is a commissioner, except in the
sixth district, and the aggregate amount of orders given
by any one school commissioner in said sixth district,
shall not exceed one-third part of the money to which
said district is entitled.

Proviso.

SEC. 5. And be it enacted, That the orphans court
aforesaid shall pay such orders of said commissioners
out of the school fund of said county; provided, that said
court is not bound to pay the same, if there should ap-
pear to be any fraud or misconduct in obtaining or giving
such orders, of which fraud or misconduct, the said
orphans court is hereby given full power to inquire and
examine by summoning witnesses, interrogating the par-
ties, teachers or commissioners under oath, or other
summary mode.

SEC. 6. And be it enacted, That the said orphans court,
as soon as they shall ascertain what amount of said fund
is allotted to each district, they shall direct the register
of wills to notify the commissioners of such district there-
of immediately.

SEC. 7. And be it enacted, That said commissioners,
in selecting the poor children to be sent to school, shall
not designate any under eight years of age, and if there
should be more poor children proper to be sent to school
in the neighborhood of any commissioner than the pro-
portion of the money for which he is authorised to draw
orders on the orphans court will educate, then such com-
missioner will equalise the benefits among such poor
children, by sending all such poor children for such time
as the funds subject as aforesaid to his orders will pay for.
