remain to be issued bonds to the amount of no more than
about three thousand dollars, under the provisions of said
act, and the said Higham, hath asked that the company
may be empowered to issue bonds for the residue of his
said debt.

CHAP. 235.
|
|
|
Be it enacted by the Central Assembly of Mary-
land, That the Annapolis and Elk Ridge Rail Road
Company be, and it is hereby authorised to issue bonds
of said company, in form as prescribed by the afore-
said act to the said John Higham, for the aforesaid sum
of nine thousand and ninety-two dollars and sixty cents,
in full of the balance of his aforesaid judgment, which
said bonds shall be paid in like manner as is provided by

said act, for payment of the bonds hereby directed to be
issued; provided, however, that no payment on account
of the bonds hereby directed to be issued, shall be made
until after the entire payment and discharge of principal
and interest of all bonds issued, and to be issued, under
the provisions of the aforesaid act.
CHAPTER 235.

Proviso.

An act to authorise the Levy Court of Frederick County,
in their discretion, to levy a sum of money to build a
Bridge over Owing's Creek, at some point north of
Elder's Ford, on the road leading from Westminster, in
Carroll County, to Hagerstown, in Washington Comity.
|

SECTION 1. Be it enacted by the General Assembly of
Maryland, That the levy court of Frederick county be,
and they are hereby authorised and empowered, in their
discretion, to levy on the assessable property of said
county, a sum of money not exceeding fifteen hundred
dollars, in three equal annual instalments, fur the purpose
of building a bridge over Owing's creek, at some point
north of Elder's ford, on the road leading from West-
minster, in Carroll county, to Hagerstown, in Wash-
ington county.

SEC. 2. And be it enacted, That the levy court of said
county, are hereby authorised and empowered to appoint
three commissioners, to view and examine the ground,
and fix upon the proper site or situation for building said
bridge, and to make condemnation of lands for the same,
and also ior the necessary road to pass to and from said
bridge, should a departure from the bed of the old road be-
