CHAP. 162.

time to offer proper security, his office shall be deemed va-
cant, and the board shall immediately proceed to make
another appointment, and so on, until proper security
shall have been given.

Bonds renew-
ed annually.

SEC. 4. And be it enacted, That all bonds conditioned
for the faithful performance of official duty, shall be re-
newed annually, although the former officer may have
been re-appointed, but nothing in this act shall be con-
strued to release the obligor on any bond, until the same
shall have been replaced by a new one.

In case of a tie.

SEC. 5. And be it enacted, That in case of a tie in the
board on any question of election, the names of the two
parties having the highest number of votes on said bal-
it, shall be immediately returned to the sheriff of Balti-
more county, who shall select one of them, and return a
certificate thereof in writing immediately to said board,
and in case of disagreement in said board on any ques-
tion of the sufficiency of security, the fact shall be im-
mediately laid before the sheriff aforesaid, whose deci-
sion shall be immediate and final in the premises, the
same to be certified to the board in writing.

No officer re-
elected, &c.

SEC. 6. And be it enacted, That no officer who has
heretofore been, or hereafter may be appointed by the
said board for five successive years, shall be re-elected
unless by unanimous vote of said board, but in all other
cases a majority of said board shall be sufficient to elect;

provided, that nothing in this section shall apply to con-
stables of Baltimore county, who may be at all times re-ap-
pointed by a majority of said board; and provided fur-
ther, that nothing in this section shall apply to the trea-
surer of said county; and whereas, it is understood that
doubts have been expressed as to the proper meaning
and effect of the third section of an act passed at the pre-
sent session, eighteen hundred and forty-six, entitled, a
further supplement to the act of eighteen hundred and
thirty-eight, chapter two hundred and one, it is hereby
declared that said section has especial reference to, and
was intended to include all those who have been hereto-
fore, as well as those who hereafter may be elected to
the office of treasurer of Baltimore county, for five suc-
cessive years, or who may have held said office without
an annual election for five successive years; and where-
as, the said office of treasurer was properly rendered va-
cant by the passage of said act, the said board are hereby
