1845.

CHAPTER 102.

A further supplement to the act entitled, an act for making
certain roads in Baltimore and Harford counties, pass-
ed at December session, eighteen hundred and fifteen,
chapter forty-eight.

CHAP. 102.

Passed Jan.
28, 1846.

WHEREAS, it is represented to the General Assembly
that the Baltimore and Harford Turnpike Company desire
to make a further extrusion of the turnpike on the Bell-Air
route to Bell-Air, which extension, when made, will be
an excess over the twenty miles of roads required to be
made in and by the original act incorporating said com-
pany; and whereas, said company is deterred from making
any extension without a prior release to and waiver of,
on the part of the commissioners of Harford and Balti-
more counties, and all claims and demands to them
accruing, under acts of assembly heretofore passed, for
and on account of expenses by them incurred in building
bridges, and in making and opening roads on the bed of
the contemplated route of said turnpike as heretofore
located; and whereas, the said extension is much desired
by citizens of said counties in the vicinity thereof, and
upon their application to the commissioners of their
respective counties, said claims and demands might be
waived, but doubts have arisen as to the power and legal
competency of said commissioners to release and waive
the same without an enabling act of the General Assem-
bly passed therefor — therefore,

Preamble.

Be it enacted by the General Assembly of Maryland,
That in case said turnpike company does make the excess
of turnpike road as aforesaid, to the town of Bell-Air,
then the commissioners of Harford and Baltimore coun-
ties respectively, be and they are hereby authorised and
empowered to release said company from any and all
claims for damages or expenses heretofore incurred by,
or accruing to them for and on account of said bridges
and roads, under and by virtue of any previous acts of
Assembly, or from claims to them due in any other way
or manner whatsoever, upon such terms and in such
manner as said turnpike company, and said commission-
ers, each for their own county respectively, may mutually
consent and agree.
