part of the capital of said company, at a price by them to
be agreed on; provided, the quantity shall not exceed
fifteen thousand acres, and provided the price per acre
shall not exceed the estimate contemplated by the origi-
nal act of incorporation and the shares of the said company
shall be at the rate of one hundred dollars per shire in-
stead of five hundred dollars per share as provided in the
original act.

CHAP. 90.
Proviso.

SEC. 2. And be it enacted, That the said Cumberland
Coal Mining Company shall be subject to the regulations
and conditions of the act. chapter two hundred and six-
ty-seven, passed March twenty eighth, eighteen hundred
and thirty-nine.

SEC. 3. And be it enacted, That the further time of
four years be allowed the Union Company for the com-
pletion of their canal or slack water navigation; provided,
said company shall, on or before the first day of August
next, file in the executive department of this State their
consent in writing, that the Chesapeake and Ohio canal
company or the State of Maryland, may at any time
hereafter take possession of the said canal, or slack
water navigation, upon the payment to the Union Com-
pany of the sums expended in the construction and re-
pairs thereof, together with interest at the rate of six per
cent per annum, deducting therefrom the nett profits
which may have been distributed to the shareholders on
account of the revenues derived from the said canal or

slack water navigation; and provided further, that the
power given in the first section of this act for the pur-
chase and sale of goods, chattels and effects, shall be
subject to the limitations and reservations in the fifteenth
section of the act of eighteen hundred and thirty-five,
chapter two hundred and fifty-five.

Proviso.
|
|
|
SEC. 4. And be it enacted, That the trustees appointed
or to be appointed under and by virtue of the original
act of eighteen hundred and thirty-five, chapter three
hundred and sixty-four, or the supplements thereto, shall,
on or before the first day of January, eighteen hundred
and forty-eight, and annually thereafter, file in Allegany
county court a full and complete report of their proceed-
ings and transactions, and the state and condition of the
assets and effects of said company, agreeably to the pro-
visions of the seventh section of the said original act, which
shall be inspected by the judges of the said county court
as a court of equity, at their first meeting thereafter, and
such action had thereon as to said court may seem meet
and proper under the seventh section of the said act of
