CHAP. 394.

Make affidavit
if required.

SEC. 2. And be it enacted, That before he proceeds
it to collect under and by virtue of this act, he shall make
out and deliver to the person or persons from whom the
same may be demanded, an account of fees, sums of mo-
ney or balances due from such person or persons, and if
required by the party, annex thereto an affidavit, that the
same is due and unpaid.

CHAPTER 393.

Preamble.

An act to extend the trial by Jury to certain cases.

WHEREAS, it is represented to this General Assem-
bly, by the petition of a number of citizens of Cecil
county, that the passage of a law is greatly desired to
extend to all persons citizens of said county, the sup-
pression of whose license has been recommended by the
grand jury the right to have all such recommendations
traversed and tried by a jury, as all other presentments
now are — therefore,

Court not to

suppress li-
cense.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That from and alter the passage of this act,
no license or licenses shall be suppressed by Cecil coun-
ty court, except by presentment by the grand jury, and
the finding by a petit jury, as in other cases of misde-
meanors: and whenever any license as aforesaid, is de-
clared by the verdict of a petit jury, upon presentment,
to be a nuisance which ought to be abated, Cecil county
court is hereby authorised and directed to abate said
nuisance and suppress said license upon the finding of
said jury and not otherwise.

Repealed.

SEC. 2. And be it enacted, That all acts and parts of
acts inconsistent with this act, be and they are hereby
repealed.
