CHAP. 31.

Authorised to
hold real pro-
perty.

Be it enacted by the General Assembly of Maryland,
That Johannes Diemer be and he is hereby authorized
and empowered to take, hold and dispose of the real
property he may now possess, or to which he may now
have, or may hereafter acquire any claim, within the
limits of the State of Maryland, in the same manner as if
he the said Johannes Diemer at the time when his claim
to such property originated or shall originate, had been

or should be a naturalized citizen of the United States;
Provided, that the said Johannes Diemer shall, so soon
after the passage of this act as the law will permit, use
due diligence to become naturalized according to the
laws of the United States; but if he should die before he
can thus become naturalized, his heirs, and assigns, and
all other persons may take and hold any property from,
through, and under him, in the same manner as if he had
been naturalized when the rights which they claim from,
through, or under him accrued.

CHAPTER 31.

An act to repeal a part of the act of Assembly of eighteen
hundred and thirty-eight, chapter two hundred and
twenty-six.

Preamble.

WHEREAS, doubts have occurred as to the true con-
struction of the third and fourth sections of the act of
Assembly of eighteen hundred and thirty-eight, chapter
two hundred and twenty-six, and as to the compliance

therewith by the Mayor and City Council of Baltimore
in the ordinance of said Mayor and City Council, ap-
proved on the ninth day of March, eighteen hundred and
forty-one, and passed for the purpose of carrying into
effect the provisions of said act of Assembly; AND
WHEREAS, the said ordinance fully answers the purposes
contemplated by the Legislature in the passage of said
act of Assembly; now therefore

Repealed.

Be it enacted by the General Assembly of Maryland,
That the third and fourth sections of the act of Assem-
bly, passed on the twenty-third day of March, in the
year eighteen hundred and thirty-nine, and entitled, an
act to vest certain powers in the corporation of the city
of Baltimore in relation to streets, be and the same are
hereby repealed, and that no proceeding under or by
virtue of any ordinance of the Mayor and City Council
