CHAP. 212.

An act relating to the Streets in, and the Public Roads in
the vicinity of Chestertown.

2, 1846.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That from and after the first day of April;
next, it shall be incumbent upon the commissioners of
Chestertown, to appoint annually, before the first day of
May, a supervisor of the streets and public alleys in said
town, and of the public road, between the said town and
Whaland's mill, and between the said town and James
Boone's, formerly Samuel Thomas' gate, and the said

supervisor shall be liable to presentment and indictment
by the grand jury for neglect of duty, in the same mari-
ner that the supervisors of the public roads in Kent coun-
ty are liable for neglect or breach of duly, and may be
fined by the county court in such sum, for such breach
or omission of duty, as the court in their discretion may

deem proper, such supervisor to have the privilege of
trial by jury, but the plea or defence of a want of funds
to mend the said streets, alleys and roads, shall not avail,
unless the said supervisor shall, within ten days after his
funds are exhausted, report such fact, in writing to the
clerk of Kent county court.

SEC. 2. And be it enacted, That before the levy
court of Kent county shall levy the sum of one hundred
dollars for mending the loads near Chestertown, under
the direction of the commissioners of Chestertown, they
shall be satisfied from the representation of the commis-
sioners of said town, that a supervisor has been appoint-
ed for a year, according to the provisions of the first sec-
tion of this act, and that he has accepted the said appoint-

ment.

SEC. 3. And be it enacted, That it shall be the duty
of the commissioners of Chestertown, to famish to the
supervisor to be appointed as aforesaid, ample funds to
mend and repair, and keep in good order, the streets, al-
leys and roads as aforesaid, and that the amount of one
hundred dollars, levied by the levy court of the county,
for the use of the commissioners of said town shall be
taken and considered by the county court, before whom
any trial shall take place, to be in the hands of the su-
pervisor, to be appointed as aforesaid.

SEC. 4. And be it enacted, That the commissioners of
Chestertown shall have full power to cause all obstruc-
tions, nuisances, impediments and offensive substances,
