CHAP. 163.

sure and inspect the same, but not otherwise; and if only
a part of the lumber belonging to such owner, and which
he shall desire to have inspected, shall have arrived at
Perryville, the said inspector may measure and inspect
the balance thereof on its way to market while in the
Susquehanna river; provided, that from stress of weather,
or some unavoidable circumstance, it cannot be taken to
Perryville; and no lumber inspected by the inspector,
herein authorised to be appointed, shall be liable to ret
inspection if sent to Baltimore by the inspectors at that
city; provided, that nothing herein contained shall au-
thorise the said inspector to inspect lumber at Havre-de-
Grace or Port Deposit.

Limits of the
town.

SEC. 4. And be it enacted, That for the purposes in this
act contained, the limits of the town of Perryville, on the
shore of the Susquehanna river, shall be deemed and
taken to extend from the north side of the rail road depot
along the Susquehanna to a tract of land called Rich Hill.

Penalty.

SEC. 5. And be it enacted, That if any inspector or
inspectors, other than the measurer and inspectors ap-
pointed under this act, shall inspect or measure lumber
at Perryville, he or they shall be subject to a penalty of
five dollars for each piece of lumber or timber which he
or they shall so inspect, to be recovered before any jus-
tice of the peace of Cecil County, as small debts are now
recovered by law, one half to the use of the State and
one half to the informer.

verned.

SEC. C. And be it enacted, That the inspector of
lumber appointed under this act, shall be governed by
the provisions of the act of December session, eighteen
hundred and eleven, chapter seventy, and the third and
fourth sections of the act of December session, eighteen
hundred and seventeen, chapter one hundred and forty
one.

Rate of in-
spection.

SEC. 7. And be it enacted, That the said inspector
shall be entitled to receive, as a compensation for inspect-
ing all boards, plank and scantling, at the rate of thirty
cents for every thousand feet, board measure, and for in-
specting shingles, he shall be entitled to receive twenty
cents for each and every thousand, one half to be paid
by the seller, and one half by the buyer.
