procure or cause to be procured their publication, for dis-
tribution as aforesaid, and also to the end that they be af-
forded to the members of the bar of the country, at a price
within the reach of all.
Resolved, That our Senators and Representatives be re-
spectfully requested to urge the subject of the foregoing
resolutions upon the attention of Congress, and procure
their early action thereon; and that his Excellency, the
Governor, be requested to forward a copy of these resolu-
tions to each of the Senators and Representatives in Con-
gress from this State.

Preamble and Resolution relative to the construction of
the act of eighteen hundred and forty, chapter twenty-
three.

Preamble.
|
WHEREAS, doubts exist whether the commissions to be
paid to the collector of taxes for the State on the tax im-
posed by the act passed at the extra session of the year
eighteen hundred and forty-one, chapter twenty-three, sec-
tion forty-five, as provided for in the forty-seventh section
of said act, is to be paid by the Mayor and City Council
of Baltimore, or to be deducted out of the amount collect-
ed; AND WHEREAS, an amicable suit has been entered in-
to between the State and the collector of said tax in the
city of Baltimore, to ascertain the true construction of said
act in this respect, and a judgment pro forma given for the
State, to bring the question promptly before the Court of
Appeals, for final decision—Therefore,
Be. it resolved by the General Assembly of Maryland,
That the Court of Appeals He requested and authorised to
hear and determine the said cause on appeal at their pre-
sent session.
