several counties of this State, passed at December session,
eighteen hundred and thirty-six, chapter two hundred and
twenty-four, having expired by limitation on the first of
February, eighteen hundred and forty-five; AND WHERE-
AS, there is no provision made by law for the collection of
fees due said clerks and registers, and it being just and
reasonable that such provision should be made—There-
fore,

Section 1. Be it enacted by the General Assembly of
Maryland, That all lees due to the clerks of the several
County courts of this State, of Howard District, clerks of
the Court of Appeals, and clerk of the court of chancery
for the Eastern and Western Shore, and of the Baltimore
city court, and register of wills in the several counties of
this State, Howard District, and of Baltimore city, on the
first day of February, eighteen hundred and forty-five,
whose term of service has expired by constitutional limi-
tation on said day, shall be received and collected by
the sheriffs of the several counties of this State, in the
same manner, as fees due and owing such officers have
been heretofore collected; and such sheriff shall use
and have the same means of enforcing and collecting

said Fees, and be liable to said clerks and registers
in the manner now provided by the existing laws of
this State; provided, that nothing in this act, shall be [so
construed, as to deprive the said clerks and registers
from collecting said fees by warrant, suit or otherwise.
SEC. 2. And be it enacted, That all fees due such clerks
and registers, shall be placed in the hands of the sheriffs
of the several counties, Howard District, and of the city
of Baltimore, wherein the debtor or debtors may reside,
on or before the first day of June, eighteen hundred and
forty-five, and that such sheriffs shall collect the same,
on or before the first day of January, eighteen hundred
and forty-six, and shall account with the said clerks and
registers for said fees; and on failure to collect and ac-
count to such clerks and registers on such day, the offi-
cial bonds of such sheriffs shall be liable to be put in suit,
at the instance and for the use of every person or persons

SEC. 3. And be it enacted, That this act shall be in
fall force from the passage hereof.
