duty of the bailiff of the town of Cumberland, within thir-
ty days from the time of his receiving the list aforesaid, to
give notice in one of the newspapers printed in the town
of Cumberland, to the persons respectively bound to pay
the same, that the amount so assessed and charged as

aforesaid must be paid within twenty days from the day
of the giving said notice; and should any sum or sums of
money, so assessed and charged as aforesaid, not be paid
within the time so limited for the payment of the same, the
bailiff of the town of Cumberland shall be and he is here-
by authorised, to sell a public sale, for cash, the whole or
any part of the property on which such assessment shall
be made, first giving not less than thirty days notice of
such intended sale in one of the newspapers printed in the
town of Cumberland; and the bailiff of the town of Cum-
berland, upon receiving the purchase money of the pro-

perty so sold, shall execute a deed or deeds of convey-
ance therefor in favor of the purchaser or purchasers,
which deed or deeds shall be good and sufficient to pass
the fee simple estate in the said property; and the bailiff
of the town of Cumberland aforesaid, after deducting from
the amount of such sale or sales the amount assessed and
charged as aforesaid upon the property so sold, the cost of
such sale or sales, the cost of advertising, and three per
centum commission to himself, in addition to the commis-
sion hereinafter mentioned and allowed, shall pay over the
balance to the person or persons entitled thereto.

SEC. 5. And be it enacted, That each of the said com-
missioners shall be allowed one dollar per day, for each
day they are employed in carrying into effect the provisions
of this law; and that the bailiff of the town of Cumberland
shall be allowed three per centum, on all sums collected
by him under the provisions of this law, which per diem
and commissions are to be considered as a part of the ex-
pense for the carrying of this law into execution, and are
to be assessed and levied as is herein before mentioned.

SEC. 6. And be it enacted, That the said street shall not
be considered to be opened until the damages, to be by
each person sustained and assessed as aforesaid, shall first
be paid to the mayor and councilmen of the town of Cum-
berland, for the use of the person or persons entitled to
receive the same.

SEC. 7. And be it enacted, That nothing in this act con-
tained shall be of any force or affect, until approved of by
the mayor and councilmen of the town of Cumberland.
