1844.

Company, and any person guilty of false swearing in an
oath taken as aforesaid, shall upon conviction be liable to
the same penalty as if the said oath were administered by

SEC. 9. And be it enacted, That any lock keeper or collec-
tor of tolls upon being dismissed from the service of the
said Chesapeake and Ohio Canal Company, if living in
or occupying a house or building, owned or hired by the
said company, shall upon receiving not less than five days
previous notice of such dismissal, remove from the same
on or before the day designated in such notice, and upon
failure or refusal to do so, it shall be lawful for the said
company by its officers, agents and servants, to use such
force as may be necessary to remove such lock keeper or
collector from the house or building occupied by him as
aforesaid.

SEC. 10. And be it enacted, That the connection of
any fence or wall with the works of the said Chesapeake
and Ohio Canal Company, in the manner authorised by
the second section of the act to which this is a supplement,
or the erection of any fence, wall, or building upon the
land of the said company, whether with or without the
permission of the said company, however long the same
may remain, shall not be deemed nor held in law as an ad-
verse possession, so as to deprive the said company of

SEC. 11. And be it enacted, That the several sections
or provisions of this bill, shall respectively commence and
take effect, so far as regards the State of Maryland, from
the passage thereof, as regards the United States and the
State of Virginia, so far as they may respectively assent
to any or all of its provisions; and on receiving the further
assent of the Legislature of Pennsylvania, they shall be
deemed to be, so far as such assent may extend, a part of
the charter of the Chesapeake and Ohio Canal Company.

Section 1. Be it enacted by the General Assembly of
Maryland, That Charles M. Thruston, John G. Hoff-
man, A. L. Withers, John Hays and Thomas Ch. Atkin-
son, be appointed commissioners to open a street in the
town of Cumberland, and they or a majority of them, are
