CHAP. 287.

to the said company the sum of twenty dollars for each of-

manner as small debts are recovered, and the said company
by its officers, agents and servants may remove any of the
obstructions, houses, sheds, buildings, wharves or other

SEC. 5. And be it enacted, That to insure a compli-
ance with and observance of the by-laws of said company,
that are now in force, and that may hereafter be adopted in
conformity with the act of incorporation and its several sup-
plements, the said president and directors or a majority
of them assembled, acting in behalf of the said company
as aforesaid, may prescribe such penalties as they may

deem necessary; provided, no penalty for a single offence
shall exceed twenty dollars, except in the case of a viola-
tion of the by-laws, which may be made for the prevention
of frauds upon the revenues of the said company, and to
secure the payment of tolls by those trading upon the said
canal, in regard to which by-laws a penalty may be im-
posed not exceeding fifty dollars, for any single offence;
and provided further, that no by-law shall be enforced
until after a copy of the same shall have been set up for
public inspection for at least ten days, at some one of the toll
houses or lock houses on the said canal within the county
in which the offence may be committed.

SEC. 6. And be it further enacted, That if any person
who has violated any of the provisions of this act, or of
the act to which this is a supplement, or any of the by-
laws of the said Chesapeake and Ohio Canal Company,
made in pursuance of either of said acts, shall be about to
leave the county in which the offence was committed, it
shall be lawful for the said company by its officers, agents
and servants to seize the boat, raft or other craft of such
person, and detain the same until the person so offending
shall have answered in the due course of law for such
offence.

SEC. 7. And be it enacted, That all fines and penalties
authorised to be enforced by this act, the collection and
enforcement of which are not herein otherwise provided
for, shall be recovered in the name of the company, before
a single justice of the peace as small debts are now re-
covered.

SEC. 8. And be it enacted, That the several collectors of
tolls on the said Chesapeake and Ohio Canal, be and they
are hereby authorised and empowered to administer, but
without charge for so doing, all oaths that may be requir-
ed by the by-laws of the said Chesapeake and Ohio Canal
