1844.

Frederick county, or such of them as have been duly and
properly elected under the act of December session, eigh-
teen hundred and forty-two, chapter two hundred and
fifty-five, be and they are hereby continued in office with
all their present powers until the election of justices of the
levy court as hereinafter provided.

SEC. 2. And be it enacted, That after the. expiration of
the term of service of the present incumbents, the levy
court of Frederick county, shall consist of five members,
not less than a majority of whom shall constitute a levy
court for transacting any business other than that of act-

SEC. 3. And he it enacted, That Frederick county shall
be divided into five levy court districts, for the purpose of
electing justices of the levy court for said county, and that
the district known as the Frederick election district, shall
constitute and form the first levy court district, which shall
elect one justice of the levy court, that the districts known
as the Hauvers, Middletown and Petersville election dis-
tricts, shall constitute and form the second levy court dis-
trict, which shall elect one justice of the levy court, that
the districts known as Jefferson, Buckeystown and New
Market election districts, shall constitute and form the
third levy court district, which shall elect one justice of the
levy court, that the districts known as the Liberty and
Woodsborough election districts, shall constitute and form
the fourth levy court district, which shall elect one justice
of the levy court, and that the districts known as the Crea-
gerstown and Emmittsburg election districts shall consti-
tute and form the fifth levy court district, which shall elect
one justices of the levy court of said county.

SEC. 4. And be it enacted, That no person shall be
eligible or capable of having a seat as a justice of
the levy court of Frederick county, who shall not have
been a resident of the levy court district in which he may
be chosen for at least six months next preceding his elec-
tion.

SEC. 5. And be it enacted, That every voter in each of
the levy court districts as described in the third section of
this act, who shall be qualified to vote for delegates to the
General Assembly, and who shall have resided at least six
months next preceding the election in the levy court dis-
trict in which he may offer to vote, shall in such levy court
district, be entitled to vote for one justice of the levy court
as hereinbefore stated, and the person having the required
residence who shall in each of said levy courts districts
respectively, receive the largest number of legal voters for
said office in his levy court district si. all be declared duly
elected justice of the levy court of Frederick county for
the levy court district in which he may be so elected.
