CHAP.
CXIV.
|
II. BE IT ENACTED, by the General Assembly of Maryland, That Robert Young, George Biscoe, Ro-
bert Bowie, Ignatias Boone and Alexander Contee, or a majority of them, be and they are hereby
authorised and required, after giving three weeks notice in the most convenient public places within
the said county, and also in the Baltimore Telegraphe, of the time, place and intention, of the
meeting, and after having taken an oath before some justice of the peace of Prince-George's county
well and truly to execute the trust reposed in them by this act, without prejudice, partiality, favor
or affection, to proceed to cause the said town to be laid out anew, and to define and regulate the
streets, lanes and alleys thereof, so as to promote the interest of the proprietors and the convenience
of the inhabitants, as nearly as may be, having regard to the former streets, lanes and alleys, and
not incommoding the present buildings.
III. AND BE IT ENACTED, That the said commissioners, or a majority of them, shall have the
power and authority to employ a surveyor and chain-carriers to effect the purpose which is intends;
and to summon witnesses, (if any may be requisite, ) and to allow them such reasonable compensation
as they may think fit, and they shall cause proper boundaries of wood or stone to be affixed to ascer-
tain the lots, streets, lanes and alleys, of the said town, and have a correct plot and certificate made of
the same, with proper explanations, to be returned to the clerk of Prince-George's county, under the
hands, who is hereby required to receive and record the same among the land records of said county
and the original to keep in his office, and a copy of such original, or the record thereof, shall be con-
clusive evidence as to the bounds of the said town, and of the lots, streets, lanes and alleys thereof
IV. AND BE IT ENACTED, That the said commissioners, or a majority of them, shall have the
power and authority to condemn such lands as they may think requisite for the streets, lanes and
alleys, of the said town, making a proper compensation to the proprietors thereof, as they in their
judgments shall deem just and right.
V. AND BE IT ENACTED, That the said commissioners, or a majority of them, shall have the
power and authority to remove all nuisances, and to make such rules and regulations for the benefit
of the inhabitants of said town as they may think proper, and. may impose such fines for the due ob-
servance thereof as they may adjudge to be just and right, not exceeding five dollars for any or,
offence, which fine may be recovered before any justice of the peace in the same manner as other
small debts out of court now are.
VI. AND BE IT ENACTED, That the said commissioners, or a majority of them, shall and may
administer an oath to the surveyor to be by them appointed in virtue, of this act, and to any chain
carrier or chain-carriers by them employed, to execute their respective duties as surveyor or chain
carriers, as the case may be, faithfully, honestly and impartially, according to the best of their skill
and judgment.
VII. AND BE IT ENACTED, That all fines and forfeitures. incurred in pursuance of this act, shall
be paid into the hands of the said commissioners, or their successors, to be by them applied in such
manner as they may think best for the improvement of said town.
VIII. AND BE IT ENACTED, That if any commissioner appointed in virtue of this act shall die,
resign, or refuse to act as such, the vacancy occasioned by such death, resignation or refusal, shall
supplied by a commissioner to be chosen by the commissioners then remaining, or a majority of there
IX. AND BE IT ENACTED, That the expence arising from the execution of this act shall be paid
by all those who are benefitted thereby, in such proper proportions as the said commissioners, or a
majority of them, shall determine.

An ACT for the payment of the journal of accounts.
WHEREAS it appears by the journal of -accounts of this session, that there is due from this
state the sum of thirty-four thousand five hundred and eighty-two dollars and thirty-four
cents and a half,
II. ENACTED, by the General Assembly of Maryland, That the treasurer of the western shore
shall and he is hereby authorised and required to the several persons, their executors, admi-
nistrators, assigns or orders, or to such of them as shall offer to receive the same, the several sums
of current money allowed to them restively, as they appear to be settled and ascertained by the
said journal of accounts, out of any money now in the treasury, or that shall come into the treasu-
ry, subject to the appropriation of the general assembly.
