apply the money raised by such lottery for the purpose of rebuilding the steeple of the German re-
formed church aforesaid.
III. AND BE IT ENACTED, That it shall be the duty of the said commissioners, before they act
as such, to lodge the bond made and entered into as aforesaid in the office of the clerk of Frederick
county court, there to be recorded, and upon such bond, or any office copy thereof, suit or suits may
be instituted against the obligors therein, or any of them, or their legal representatives, for any
and each or noncompliance with the condition of the same.

An ACT for the relief of John R. Caldwell, of the city of Balti-
more.
WHEREAS it hath been, represented to this general assembly, by the petition of said Cald-
well, that he was included in the general insolvent law, passed at November session, eighteen
hundred and four; that after the passage of the said law, he made application to the justices of Bal-
timore county court, praying relief pursuant to the provisions of the said act; that the said justices
did order and direct the sheriff of Baltimore county to release the body of the said Caldwell, which
as then in actual confinement, and did also appoint the first day of January, eighteen hundred and
six for the said Caldwell to appear and obtain his final discharge, on his complying with the condi-
tions prescribed by the said act; And whereas the powers of the said court, and of the justices
thereof, have been suspended by operation of the acts of assembly passed at this present session for
tering the judiciary system of this state, so that the said court is not authorised to extend to the
said Caldwell the relief granted him by the said insolvent law: And whereas since the suspension
of the functions of the said court of Baltimore county, the said Caldwell hath been taken in execu-
tion by virtue of a writ of capias ad satisfaciendum, issued against him, and is now imprisoned in the
public gaol of Baltimore county; and this general assembly thinking it reasonable that the said Cald-
well should not be deprived of the benefit of the said insolvent law, therefore,
II. BE IT ENACTED, by the General Assembly of Maryland, That the sheriff of Baltimore county
be and he is hereby authorised and directed to release the body of the said John R. Caldwell from
confinement, he the said Caldwell first entering into bond, with good and sufficient security, payable
to the said sheriff, in double the amount of the debt and costs contained in the said execution, and
conditioned for his appearance at the next county court to be held for Baltimore county on the re-
ason of said execution, and not depart the said court without the leave thereof, and in all things
comply with, fulfil and perform, the judgment of the said court touching the premises; provided ne-
vertheless, that nothing in this act contained shall operate as a final discharge for the said Caldwell
from the claims of his creditors, upon any other terms than by his complying with the provisions
contained in the said insolvent law.

An ACT to authorise the drawing of a lottery within the city of
Baltimore for the purpose therein mentioned.
WHEREAS it is represented to this general assembly, by the memorial of the reverend Samuel
Knox, of the city of Baltimore, that he has incurred great expence in the establishment of
literary institution within the said city, founded upon the laudable principle of diffusing the bles-
sings of science and literature among the great body of the community: And whereas it is reasona-
ble that his own private resources should be aided by the interference of the government in a work
as praiseworthy and patriotic as the improvement of the rising generation in the principles of vir-
tue and science; therefore,
II. BE IT ENACTED, by the General Assembly of Maryland, That from and after the passage of this
act, it shall and may be. lawful for the mayor and: city council of Baltimore to authorise the afore-
said Samuel Knox to institute a scheme of a lottery within the said city, consisting of one or more
classes, under the direction of John M'Kim, junior, James Mosher, Thomas Dixon, Thomas M'El-
lerry and John Hillen, who are hereby appointed managers of such lottery, and to dispose of tickets
herein, for the purposes aforesaid, under such limitations as the mayor and city council shall by or-
dinance direct and appoint; provided, that not more than twelve thousand dollars be raised by any
scheme in virtue of this act.
