ability Policy covering disabilities due to illness or dis-
ability resulting from accidents incurred when not engaged
in the performance of his duties shall be deducted from
his retirement pay. The Board of Aldermen may cause
such retired officer to be examined from time to time, by
two physicians, and if found capable of performing the
duties of a policeman, his payments shall cease.

(c) Any member of the force, including the Chief of
Police, who has served on the Maryland State Police Force,
or as a regular special policeman of the Frederick City
Police Force, and who has joined the Frederick City Police
Force immediately after such prior service, shall be given
credit for the number of years he has served on said other
police force in determining eligibility for benefits provided
by this section, but in no event shall said member be given
credit for more than 10 years' previous service.

212. Every act or omission designated as a misdemeanor
in this charter, unless otherwise provided, shall be punish-
able upon conviction before any trial magistrate or in the
Circuit Court of the county within which the offense is
committed by a fine not exceeding [one] Three Hundred
Dollars [($100. 00)] ($300. 00) or imprisonment for [ninety
days] six months or both in the discretion of the magis-
trate or court. The party aggrieved shall have the right
of appeal as is now provided under the general laws of the
state. Where the act or omission is of a continuing nature
and is persisted in, in violation of the provisions of this
charter or of any ordinances, rules or regulations formu-
lated hereunder, a conviction for one offense shall not be
a bar to a conviction for a continuation of the offense sub-
sequent to the first or any succeeding conviction.

FIRE COMPANIES

202A. (a) The Mayor and Aldermen of Frederick are
hereby authorized and empowered to make financial ap-
propriations to the independent Hose Company No. 1, the
United Steam Fire Company No. 3, the Junior Fire Com-
pany No. 2 and the Citizens Truck Company, all being
bodies corporate of the State of Maryland, located within
the corporate limits of Frederick City, in such sums or
amounts as it shall think proper, for the purpose of defray-
ing the expenses of said fire companies, for the purchase
of equipment, maintenance of fire houses and equipment,
payment of salaries and such other necessary expenses as
the Mayor and Aldermen of Frederick shall think proper.
None of said Companies shall purchase any new equipment
