Magistrates System", and to enact in lieu thereof a new
section to be known as Section 100 (Prince George's
County) and to follow immediately after Section 100
(Montgomery County), relating to the appointment of
Justices of the Peace as Clerk and Deputy Clerk in the
Trial Magistrates' System of Prince George's County,
outlining their duties and powers and providing for pay-
ment of their salaries.
SECTION 1. Be it enacted by the General Assembly of Maryland,
That Section 100 (Prince George's County) of Article 52
of the Annotated Code of Maryland (1951 Edition), title
"Justices of the Peace", sub-title "Trial Magistrates Sys-
tem", be and it is hereby repealed and that a new section
be and it is hereby enacted in lieu thereof to be known as
Section 100 (Prince George's County) and to follow imme-
diately after Section 100 (Montgomery County), and to
read as follows:
100. (Prince George's County) There shall be ap-
pointed two Justices of the Peace, one who shall be desig-
nated as Clerk of the Trial Magistrate's Court and the
other as Deputy Clerk of the Trial Magistrate's Court, for
each of the Trial Magistrates sitting for criminal, motor
vehicle and civil cases in Prince George's County, Mary-
land. The Clerk shall have charge of the Trial Magistrate's
Office and it shall be his duty to attend or to have someone
by him designated to attend all court hearings and pro-
ceedings, and to keep proper records of said proceedings,
as heretofore required to be kept by the Trial Magistrate.
It shall be the duty of the Clerk to keep dockets of the
proceedings, collect all fines and costs and any or all suits
or cases, except in juvenile causes, and to make reports
and remittances of said fines and costs as heretofore re-
quired of the Trial Magistrate. The Clerk and Deputy
Clerk shall each have the authority to administer oaths and
power to execute bonds, recognances, replevin attachment
bonds, and all other writs, summons, affidavits and bonds
in connection with the Trial Magistrate's Office. They
shall each have power to sign commitments to jail and
releases therefrom. The Justice of the Peace designated
as Clerk shall have charge of all the employees in the Trial
Magistrate's Office. Transcripts of civil, criminal and
motor vehicle cases, when signed by the Justice of the
Peace designated as Clerk or Deputy Clerk, shall have the
. same force in effect as those heretofore signed by the Trial
Magistrate. Salaries of the Justice of the Peace designated
as Clerk and Deputy Clerk shall be paid by the County
Commissioners and shall not be less than $4, 000 per annum
