conviction of such offense, be liable to a fine of not less
than twenty-five dollars, nor more than two hundred dol-
lars for each offense, to be recovered by the Burgess
MAYOR and Council of Boonsboro before a justice of the
peace, as other fines are recovered, or to imprisonment in
the county jail or in the House of Correction for a term of
not less than six months nor more than twelve months, or
both fine and imprisonment, in the discretion of the justice
of the peace, one-half of such fine to go to the informer and
the balance to the Burgess MAYOR and Council of Boons-
boro for the purpose of this Act, and any person or persons
convicted before a justice of the peace under the provisions
of this section, shall have the right of an appeal within ten
days to the Circuit Court for Washington County, and
shall be held by recognizance or be committed to the
County Jail to appear before the next regular jury term
of the Circuit Court for Washington County.

SEC. 10. And be it further enacted, That the said Bur-

gess MAYOR and Council are authorized to fix rates for
the use and consumption of water supplied for any purpose,
and may, in their discretion, place meters or other appli-
ances for the purpose of measuring the water used by con-
sumers and make a rate or charge therefor accordingly, and
all sums of money which may become due and owing to the
town of Boonsboro as will appear from the books of said
town from time to time, for water rentals or services,
shall be and constitute a lien upon the real property to, in
or upon which such water service is supplied.

SEC. 11. And be it further enacted, That the Burgess
MAYOR and Council are hereby authorized and empowered
to do all acts necessary and proper to carry out the provi-
sions of this Act, whether such powers are specially herein
mentioned or not, and to pass any and all ordinances
necessary for carrying out of the provisions of this Act.

SEC. 12. And be it further enacted, That the said
Burgess MAYOR and Council are authorized to provide by
ordinance for the protection of the said water works, pipes,
hydrants, fire plugs or other parts thereof, and to provide
penalties for any violation of such ordinances not incon-
sistent with the provisions of the existing charter of the
said town of Boonsboro.

SEC. 13. And be it further enacted, That the said
Burgess MAYOR and Council of Boonsboro, before issuing
any bonds hereunder, shall first, at a special or regular
