said transfer and conveyance, the Board of County Com-
missioners of Talbot County shall maintain and use the
same as a public wharf open to general public use, PRO-
VIDED, HOWEVER, THAT SAID TRANSFER AND
CONVEYANCE SHALL FAIL AND ALL RIGHT, TITLE
AND INTEREST TO THE SAID PREMISES AND
PROPERTY SHALL REVEST IN THE STATE ROADS
COMMISSION IF THE STATE ROADS COMMISSION
SHALL RE-ACTIVATE THE CLAIBORNE-ROMAN-
COKE FERRY, OR IF, AT ANY TIME IN THE FU-
TURE, THE BOARD OF COUNTY COMMISSIONERS
OF TALBOT COUNTY SHALL NEGLECT OR FAIL TO
RECEIVE AND MAINTAIN THE SAME AS A PUBLIC
WHARF OPEN TO THE GENERAL PUBLIC USE.
SEC. 2. And be it further enacted, That this Act shall
take effect June 1, 1953.

AN ACT to repeal and re-enact, with amendments, Section
661 (j) of Article 66C of the Annotated Code of Mary-
land (1951 Edition), title "Natural Resources, " sub-title
"Oysters and Clams, " providing that in any suit docketed
by protestants against any lease of submerged oyster
lands, the defendant shall be the applicant for said lease
and not the Department of Tidewater Fisheries.
SECTION 1. Be it enacted by the General Assembly of
Maryland, That Section 661 (j) of Article 66C of the An-
notated Code of Maryland (1951 Edition), title "Natural
Resources, " sub-title "Oysters and Clams, " be and it is
hereby repealed and re-enacted, with amendments, to read
as follows:
