to the sale of milk or milk products from bulk dispensers
approved by the health authority.
SECTION 1. Be it enacted by the General Assembly of Maryland,
That Section 539 of Article 43 of the Annotated Code of
Maryland (1951 Edition), title "Health", sub-title "Milk",
be and it is hereby repealed and re-enacted, with amend-
ments, to read as follows:
539. All pasteurized milk and milk products shall be
placed in their final delivery containers in the plant in
which they are pasteurized. Dipped milk or dipped milk
products shall not be sold in this State, and no producer or
distributor shall transfer milk or milk products from one
container to another on any street or roadway or in any
vehicle, store or other place, excepting only such place and
in such manner as may be approved by the health authority.
All milk or milk products sold for consumption on the
premises shall be sold only in the original container, except
in those localities where the health authority finds that
milk or milk products are not reasonably obtained in con-
tainers of a suitable size for such sale or service, and
because of such finding has promulgated a regulation mak-
ing an exception for such locality [. ]; provided that milk
or milk products may be sold from bulk dispensers ap-
proved by the health authority, sealed in the plant in
which the said milk or milk products are pasteurized and
equipped with an approved device to dispense said milk
or milk products directly to the receptacle used by the
consumer. It shall be unlawful for any person to keep for
sale milk or fluid milk products at any temperatures in
excess of 60° F. Where containers of milk or milk products
are kept in water, it shall be unlawful for the tops thereof
to be submerged. No person licensed under this sub-title
shall use or permit the use of any apparatus, equipment,
utensil or container intended for use in the processing or
packaging of milk or milk products for any other purpose
whatsoever, nor shall any person to whom milk or milk
products have been delivered in returnable containers make
any use of such containers for any purpose whatsoever
after emptying the content therefrom, and all persons
receiving milk or milk products in such containers shall
thoroughly cleanse the same before returning or surren-
dering them to the distributor or milk plant, and such
surrender from premises posted by the health authority
shall be made only in accordance with the regulations of
such authority.
