from the time he is relieved from active duty or service
he shall again be actively employed by his employer or
employing unit at the time he left for active service, and
(c) if he shall not have previously taken any other em-
ployment except temporary employment after he has ap-
plied for re-employment in his former classification or
position in the State Service, and has been refused imme-
diate re-employment for causes beyond his control; pro-
vided, however, that if such person has withdrawn any
part of his accumulated contributions, he shall be entitled
to repay the sum withdrawn into the pension or retire-
ment fund or system, including the Teachers' Retirement
System of the State of Maryland, with regular interest
thereon to the date of repayment and, if otherwise quali-
fied, be entitled to the benefits of this section as if such
withdrawal had not been made. If under the above re-
strictions any such person be again actively employed or
reinstated as a regular employee on a leave of absence,
in any position for which membership in any pension or
retirement fund or system, including the Teachers' Retire-
ment System of the State of Maryland, is made a condition
of employment within one year from the time he is relieved
from active duty, he shall receive credit as membership
service for the period of his absence. During the period
of such absence of any person who was employed by the
State or any agency thereof, including teachers, at the
time he entered active service, the State or agency thereof
shall make its contributions on behalf of such employee
as it would have made had he not been absent and had
retained his status as an employee during the period of
his absence and shall also make on behalf of such employee
the contributions which such employee would have made
had he not been absent and had retained his status as an
employee during the period of his absence. Such person,
however, shall have no right to withdraw any part of any
such contribution made by the State or any agency. The
Boards, trustees or others charged with the administration
of any pension or retirement fund or system are hereby
authorized to issue rules and regulations to carry out the
provisions of this section, any present rules and regula-
tions to the contrary notwithstanding.
SEC. 2. And be it further enacted, That this Act shall
take effect June 1, 1953.
