AN ACT to add a new section to Code of Public Local Laws
of Prince George's County (1943 Edition), being Article
17 of the Code of Public Local Laws of Maryland, title
"Prince George's County", sub-title "Upper Marlboro",
said new section to be known as Section 1411 of said
Article, and to follow immediately after Section 1410
thereof, providing that the Town Commissioners may
acquire by condemnation the interest of any person in
and to land in the vicinity of Upper Marlboro and setting
forth the procedures by which to acquire such interest,
and providing for a referendum thereon.
SECTION 1. Be it enacted by the General Assembly of
Maryland, That a new section be and it is hereby added to
the Code of Public Local Laws of Prince George's County
(1943 Edition), being Article 17 of the Code of Public
Local Laws of Maryland, title "Prince George's County",
sub-title "Upper Marlboro", said new section to be known
as Section 1411 of said Article, and to follow immediately
after Section 1410 thereof, and to read as follows:
1411. Whenever it shall be deemed necessary by the
Town Commissioners of Upper Marlboro to take or acquire
any lands, water rights, structures or building either in fee
or as an easement for the purposes of streets, - alleys, ways,
roads, storm drainage and water and sewage service, the
Town Commissioners of Upper Marlboro may purchase
the same from the owner or owners thereof, or, failing to
agree with the owner or owners thereof may condemn the
same by proceeding in the Circuit Court for the County
in which the said lands, water rights, structures or build-
ings are located, as now or hereafter is provided for con-
demnation of land by public service corporations in Article
33A of the Public General Laws of Maryland; and the said
Town Commissioners may at the same time condemn the
interest of any tenant, lessee or other person having an
interest in said land or other property. At any time after
ten days after the return and recordation of the verdict or
award in said proceeding, the Town Commissioners may
