AN ACT to repeal and re-enact, with amendments, Section
1 of Article 63 of the Annotated Code of Maryland
(1951 Edition), title "Mechanics' Lien", making more
definite AND UNIFORM the limitation on applicability
of mechanics' liens by substituting fixed dollar limita-
tions instead of a percentage and by providing a lien for
materials in Baltimore City and a specific exemption
under certain circumstances.
SECTION 1. Be it enacted by the General Assembly of Maryland,
That Section 1 of Article 63 of the Annotated Code of
Maryland (1951 Edition), title "Mechanics' Lien", be and
it is hereby repealed and re-enacted, with amendments, to
read as follows:
1. Every building erected and every building repaired,
rebuilt or improved to the extent of [ one-fourth its value
in Baltimore City and in any of the counties ] more than
Five Hundred Dollars in Baltimore City or more than
Three Hundred Dollars in any of the counties shall be
subject to a lien for the payment of all debts contracted
for work done for or about the same, and for materials
furnished for or about the same, including the sodding,
seeding or planting in or about the premises, of any
shrubs, trees, plants, flowers or nursery products of any
kind or description and the grading, filling and landscap-
ing thereon [and in the counties every such building shall
also be subject to a lien for the payment of all debts con-
tracted for materials furnished for or about the same,
including the sodding, seeding or planting in or about the
premises of any shrubs, trees, plants, flowers or nursery
products of any kind or description and the grading, fill-
ing and landscaping thereon. ] Provided,, that in Baltimore
City no building erected, repaired, rebuilt, or improved
shall be subject to a lien for the payment of labor or
material for the planting, sodding, seeding of any nursery
product, including shrubs, trees, plants, flowers or grad-
ing or filling or for any type of landscaping work.
