260. No fee or costs whatever in addition to or in ex-
cess of those authorized by Sections 258 and 259 shall be
charged in connection with any action or proceeding before
such Justice of the Peace. No Justice of the Peace, officer
or clerk shall be entitled for his own use or benefit to any
of the foregoing fees or costs, or to any other fees or costs
for services performed by him. Any person who shall
demand, charge or receive any fee, cost or amount in viola-
tion of this section shall be guilty of a misdemeanor and
upon conviction thereof shall be subject to pay a fine of
not less than $10. 00 nor more than $100. 00 for each offense.

261. If it appears the ends of justice be best served by
waiver of prepayment of any fees or costs provided in Sec-
tion 258, any Justice of the Peace shall have power to
waive the prepayment of the same. Where a party desires
a waiver of the prepayment of fees or costs, he shall under
oath, answer such inquiries as may be made of him re-
specting his financial status and ability to pay. Any willful
false swearing under the provisions hereof shall be pun-
ishable as perjury under the criminal laws of the State.

SEC. 2. And be it further enacted, That this Act shall
take effect June 1, 1953.
